At Portland Tractor Inc (PTI), we are committed to providing our customers with top-quality solutions backed by solid industry-standard warranties. This is part of our promise to deliver reliability and satisfaction with every purchase. PTI is delighted to offer this limited warranty to our customers, governed by the terms and conditions specified below.
1. DEFINITIONS
Rebuilt: Components are disassembled and thoroughly inspected. Wear items are replaced with new parts, while hard parts are inspected and guaranteed to meet usability specifications. Whenever feasible, components are tested to verify their correct functionality.
As-is/Where-is: A product sold in its current condition, without any warranties expressed or implied.
New Non-OEM: Products manufactured and supplied by a company other than the original equipment manufacturer (OEM).
New OEM TAKE OFF: A product that has never been operationally used including take-off parts installed on a machine but not operated.
Warrantable item: A part or component that serves as the basis for a warranty claim, which must be returned to the seller in fully assembled condition. The item may undergo inspection and evaluation to determine its eligibility for warranty coverage, including whether it can be repaired, rebuilt, or exchanged.

3. LIMITED WARRANTY OVERVIEW
*Subject to eligibility in Section 4, Portland Tractor provides a Limited Warranty against defects in material and workmanship, as detailed in Section 2, unless otherwise specified. The customer is required to notify Portland Tractor of any defects in material or workmanship within the respective warranty period for each type of part. If a Covered Defect is discovered before the warranty period ends, and is approved as a Valid Warranty Claim, Portland Tractor may satisfy the claim, at their sole discretion, with any of the following options: Repair the product using new or used parts within OEM specifications; Exchange with a new, rebuilt, or functionally equivalent product; or Refund the purchase price.
4. ELIGIBILITY, EXCLUSIONS and LIMITATIONS
a) The warranty applies only to Warrantable Products outlined in section 2.
b) The warranty is non-transferable and can only be redeemed by the original purchaser.
c) The warranty excludes costs for installation, removal, shipping, or replacement.
d) Warranty is void if part or component is opened by any party other than Portland Tractor Inc. without prior authorization.
e) The warranty does not cover:
- Use and/or service of a component or a part thereof that is not considered to be "normal" use or service of the component;
- Improper installation or maintenance;
- Damage to the component or a part thereof resulting from overload, abuse, misuse, neglect, faulty installation, contamination, aeration, or cavitation;
- Dismantled or modified components
- Removal of Work Ticket number / PTI Label. No warranty given without work ticket reference number
- Cosmetic issues unrelated to material or workmanship defects.
f) Only claims adhering to the Valid Warranty Claim Procedure are eligible. Portland Tractor reserves the right to void non-compliant complaints
g) Portland Tractor has sole discretion in determining Valid Warranty Claims, and these determinations are final and may not be appealed.
h) Claims may be voided if the warrantable item is not returned within 30 days of claim.
i) Products replaced or repaired as-is, without additional warranty
j) In no event shall Portland Tractor be liable for damages exceeding the product's purchase price, including indirect, punitive, or consequential damages.
LIMITATION OF WARRANTY: THIS WARRANTY SHALL BE THE ONLY WARRANTY APPLYING TO ANY MATERIALS OR PRODUCTS AND SHALL BE IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND SHALL BE IN LIEU OF ALL OTHER OBLIGATIONS AND LIABILITIES, INCLUDING NEGLIGENCE, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THE SALE OR FURNISHING OF PRODUCTS AND/OR MATERIALS, THEIR DESIGN, SUITABILITY FOR USE, INSTALLATION, AND OPERATION.
By purchasing product from Portland Tractor, the customer understands and agrees that the sole remedies under this warranty are as set forth above and upon satisfaction of any of the aforesaid remedies, Portland Tractor shall be immediately released from any and all further claims and damages, known and unknown, then existing or thereafter arising.
EXCLUSION OF DAMAGES: With respect to any claim whatsoever asserted by the Customer against Portland Tractor, Customer understands and agrees that the Customer shall have no right to recover or request compensation for, and Portland Tractor shall not be liable for, incidental, consequential, secondary or punitive damages, special damages (including but not limited to loss of time or use, or injury to person or property, or labor costs incurred in removal or installation of defective materials or parts), damages for aggravation, mental anguish, emotional distress or pain and suffering; or for attorneys’ fees or costs.
